This Privacy Policy (“Policy”)  describes how FortuneX group (collectively “FortuneX”, “we,” or “us”) and each member of the FortuneX group for whose services you registered; collect, use, disclose, and process your personal data through its website, platform and other online products and services that are developed to offer FortuneX Services and includes other independently-operated platforms, websites and clients that FortuneX and its affiliates develop.

This Privacy Policy applies to all personal data processing activities carried out by us across platforms, websites, and departments of FortuneX. To the extent that you are a customer or user of our services, this Privacy Policy applies together with any terms of business and other contractual documents, including but not limited to the Terms of Use on this website.

We encourage you to read this Privacy Policy carefully as it forms part of the FortuneX terms and conditions, terms of business, agreement with you, and/or terms of use, as the case may be.

You are advised to use any of the FortuneX Services and Products only if you agree to the Privacy Policy here, and if you do not agree with how we collect and process your personal data, please refrain from continuing to use our services.

 

About Personal Data and How We Collect and Process Your Data?

Personal data is data that identifies an individual or relates to an identifiable individual. This includes data that you provide to us, data that is collected about you automatically, and data we obtain from third parties.

When you sign up for a FortuneX Account, we will ask you to provide us with some data about yourself, including your name, email address, and telephone number. This data is either required by law (e.g., to verify your identity and comply with KYC “Know Your Customer” or “Travel Rule” obligations), necessary to provide the requested services (e.g., you will need to provide your email address, or telephone number in order to create an account), or is relevant for certain specified purposes. Other documentation that we may require will include but is not limited to a copy of your passport, residency permit, visa or national identity card, utility bill, and other documentation as may required by us in order to comply with our regulatory obligations.

You may provide this data to us either directly or by signing in to your account/service with a third party, including without limitation, via Facebook or Google. In some cases, if we add services or products, you may be asked to provide us with additional data.

Failure to provide the data required implies that FortuneX will not be able to offer you our services.

 

What Will We Use Your Data For?

The main purpose of collecting our users’ personal data is to ensure that we can provide, maintain, and improve our Services and products to customize our user’s experience with us. Data that we collect is also used for:

  • Verify your identity and carry out checks that we are required to conduct by applicable laws and regulations, including without limitation, “Know Your Customer” (KYC), antimony laundering, fraud, sanctions, and politically exposed person (PEP) checks;
  • Contact you on matters related to your FortuneX account, including to request any additional data or documentation;
  • Provide you with notices related to your FortuneX Account, general updates, market updates, and other marketing materials, including about the services and products offered by FortuneX
  • Tailor the products and services offered through the platform and website to you, including without limitation, to perform any suitability or appropriate assessments for using our services and/or products, such as our high-leveraged trading services and Social Trading Features;
  • Assess your credit risk;
  • Assess your risk score according to parameters determined by FortuneX;
  • Maintain administrative records relating to our business;
  • Set up security measures to secure your account, including without limitation, carrying out two-factor authentication (“2FA”);
  • Provide you with all or any FortuneX services.
  • Carry out our obligations owed to you;
  • Comply with our regulatory and other legal obligations;
  • Administer transactions including deposits, chargebacks, and payments;
  • Monitor trading activity on FortuneX, including detecting inconsistencies in payments and trades and looking out for illegal activities;
  • Determine whether a payment method is being abused;
  • Compile statistical analysis of the pages of our platform and websites;
  • Monitor and analyze all of FortuneX business;
  • Investigate and manage inquiries, disputes,and legal proceedings and comply with court orders, mandatory dispute resolution determinations, and mandatory government authority or law enforcement orders;
  • Provide data about you and your trading with us to credit reference/reporting agencies;
  • Participate in crime prevention, legal and regulatory compliance and assist regulatory, cybercrime, data,and data protection agencies and police with their inquiries and enforcement, even if not compelled to do so;
  • Develop and market other products and services.

 

Update of Data from Time to Time

You can update your data at any time by visiting your Account Profile page when you log into your FortuneX Account. We recommend that you update your data regularly, to ensure that the FortuneX functions offered to you are appropriate for your current circumstances. You further agree to update such data upon FortuneX’s request, if FortuneX considers the data provided as untrue, incorrect, incomplete, and/or inconsistent with other data provided by you at any time. You acknowledged that we may rely upon such data and that you are responsible for any damages or losses that may result from any inaccuracies, including without limitation the inappropriateness of our Services to your Account.

 

When You Contact Us

If you contact us by telephone, email, post, or use another function offered by FortuneX, such as the chat feature, we will collect any data about the communication and any additional data that you choose to give us. We will use this data to review, investigate, and respond to any comment or question that you may raise. Please note that we record and retain all telephone calls and other communication with us and may use it in our dealings with you, including any dispute resolution or legal proceedings.

 

When a User Invites Another User to use FortuneX

Users of FortuneX can invite their contacts to sign up for an account with FortuneX. We only collect the email addresses of individuals that users choose to invite to join FortuneX and we only use the email addresses for sending an invitation to the individual at the request of the existing user.

 

Automatically Collected Data

To the extent permitted under the applicable law, we may collect certain types of data automatically whenever you interact with us or use the services. This data helps us address customer support issues, improve the performance of our services, maintain and or improve your user experience, and protect your account from fraud by detecting unauthorized access.

These data includes but is not limited to:

  • Financial data: We collect financial data related to your use of the Services, including data you provide to us or that we collect from public sources.
  • Log data: We collect log data about your use of the Services, including the type of browser you use, platform version, access time, pages viewed, your IP address, any other network identifiers, and the page you visited before navigating to our Services。
  • Device data: We collect data about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers, and mobile network data。
  • Activities on the Platform/Website: We collect records of activities on the platform and website, including your account details, the time, value, and currency of any deposit, withdrawal, or transaction made, and the payment method。
  • Location data: In accordance with your device permissions, we may collect data about the geolocation of your device。

We may also collect data about you from third parties when you use or connect to FortuneX by or through a third party platform, such as Facebook or another site, you allow us to access and/or collect certain data from your third-party platform profile/account as permitted by the terms of the agreement and your privacy settings with the third party platform. We will share such data with the third-party platform for their use.

 

Unsolicited Data

If you provide us with the personal data that we have not requested, then we will only retain that data that we are entitled or required to hold because of the products and services we provide. However, if this additional data is surplus to our requirements but is provided to us in a manner where it is combined with data that we are either required to or entitled to retain then you acknowledge that this unsolicited data may be held by us in the same manner as the balance of your personal data.

 

Disclosing our User’s Data

We will not share your personal data except for when:

  • Between and among the FortuneX group and affiliates, subsidiaries,and other companies under the ownership of FortuneX;
  • With professional advisors, vendors, consultants, and other service providers, such as payment service providers, IT hosting companies, banks, other financial institutions, and credit reporting/reference agencies who need to access such data to carry out our request;
  • in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of FortuneX by another company;
  • disclosure in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
  • if we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property, and safety of FortuneX or others; or.
    • where we have your consent will get your permission before sharing your personal data with a third party.

 

If FortuneX discloses your personal data to service providers and business partners, in order to perform the services requested by our users or to comply with our legal and regulatory obligations, such providers and partners may store your personal data within their own systems. We require them to protect the confidentiality of this personal data and comply with all relevant privacy and data protection laws.

 

Where We Store Your Personal Data

Our operations are supported by a network of computers, servers, other infrastructure and data technology, and third-party service providers. We and our third-party service providers and business partners store and process your personal data in the United States of America. Courts, law enforcement, and security agencies of this jurisdiction may be able to use legal processes to access your personal data.

 

How Your Personal Data is Used with Our Social Sharing Features

If you’re using the FortuneX services via social networks, our platform will be granted access to your social network account general data which includes your name and username in the social network, profile picture, gender, networks, user ID, friend list, and any other data you have permitted to be shared depending on your privacy setting on your social media account.

 

Advertising and Analytics Services Provided by Others

We may allow our advertising and analytic partners to make analyses or serve advertisements for our products and services on behalf of the FortuneX businesses. This may involve cookies and other technologies to collect data about your use of Services. This data may be used by FortuneX, among other things, to analyze and track data, to deliver customized advertising and content targeted to certain users on the FortuneX services, and to better understand our users’ online activity in connection with the service.

 

Promotional Communications

You may opt out of receiving promotional emails or text messages from FortuneX by unsubscribing to our email newsletter and text messages blasting. If you opt-out, we may still send you non-promotional emails, such as service messages about our ongoing business relationship.

 

Privacy on Digital Assets and Blockchains

Your use of digital assets may be recorded on a public blockchain. As blockchains are decentralized or third-party networks that are not controlled or operated by FortuneX, we are not able to erase, modify, or alter personal data on such networks.

You acknowledge that you are aware that your activities will be recorded on the public blockchain, and you shall be liable for your own actions.

 

Data Retention

When your personal data is no longer necessary for the purpose for which it may be lawfully processed, we will remove any details that will identify you, or we will securely destroy your records. We may need to maintain records for a significant period of time after you cease using our services for legal, regulatory, or other compliance obligations. The period for which we will retain your personal data will vary depending on the purposes that it was collected for, as well as the requirements of any applicable law or regulation.

Additionally, we are subject to certain anti-money laundering laws which may require us to retain the following for a period of time after you stop using our services:

  1. A copy of the records we used in order to comply with our users’ due diligence obligations;
  2. Supporting evidence and records of transactions with you, etc.

If you have a FortuneX account, we will store your personal data for as long as you maintain that account and after you cease holding an account, for as long as we are required to by laws and regulations that are applicable to us.

  • Relying on our own or someone else’s legitimate interests to process your personal data except if we can demonstrate compelling legal grounds for the processing or for the establishment, exercise, or defense of legal claims;

Automated decision-making and profiling. If we have made a decision about you based solely on an automated process that affects your ability to access our services or has another significant effect on you, you can request not to be subject to such a decision unless we can demonstrate to you that such decision is necessary for entering into, or the performance of, a contract between you and us. However, FortuneX reserves the right to deny your request if such personal data is essential for us to provide our services to you. We may not be required or able to meet your request, or we may only meet your request in part. If you have any concerns about our processing of personal data that we are not able to resolve, you may lodge a complaint with a competent data protection authority.

Withdraw Consent. You have the right to withdraw consent to processing based on consent at any time. Note this will not affect the lawfulness of processing based on consent prior to the withdrawal of consent or on grounds where consent is not required.

 

Changes to this Privacy Policy

Our privacy policy is reviewed regularly in light of new regulations, technologies, and any changes to our business operations. Any personal data we process will be governed by our most recent Privacy Policy. We will update the “Last Updated” date accordingly at the begging of this Privacy Policy. Please review this policy from time to time. We will announce any material change to this Privacy Policy on our website.

 

Security and Integrity of Data

FortuneX protect your personal data by using data security technology and using tools such as firewalls and data encryption. We also require that you use a personal username and password everytime you access your account online. As set out in our Terms of Use, you must not share your login credentials with anyone else. We recommend that you do not use the same password across different platforms and services. We also encourage you to activate Two Factor Authentication (“2FA”) in your account. 2FA requires you to enter a verification code sent to your mobile phone via SMS in order to access your account.

 

Dealing with Minors

FortuneX services and products are not made available for users under the age of 18 (or the age of legal consent for the jurisdiction where the user is located) (a “Minor”). We do not knowingly collect personal information from or about Minors. If you are a Minor, you should not download or use any of our services nor provide any personal information to us. If we become aware that a Minor has shared any information with us, we will take legally permissible measures to remove the date from our records. Your account will then be terminated and you will not be allowed to use any of our products and services.
